What Is Divorce?

Divorce is the process of people with a legal relationship separate their assets, debts, and time related to their children.  Divorce can be complicated or easy depending on the issues to be separated, and whether or not the parties have any agreements.  

Here at Whalley Law, we searched the web to see how others defined divorce.  Here is what we found:

Contested divorces mean that one of several issues are required to be heard by a judge at trial level this is more expensive, and the parties will have to pay for a lawyer’s time and preparation. In such a divorce the spouses are not able to agree on issues for instance child custody and division of marital assets. In such situations, the litigation process takes longer to conclude.  The judge controls the outcome of the case. Less adversarial approaches to divorce settlements have recently emerged, such as mediation and collaborative divorce settlement, which negotiate a mutually acceptable resolution to conflicts. An uncontested divorce is essentially a simplified divorce proceeding, in which couples are able to avoid lengthy court hearings and hefty court fees by reaching an out-of-court agreement on the following issues: The division of marital assets and debt; Spousal maintenance awards; and child-related aspects of divorce, including child support, custody arrangements, visitation, and parenting plans. Those who opt for an uncontested divorce will need to include details about these arrangements in a marital settlement agreement before a court will issue a final court order.
