We handle your fight

Our Idaho personal injury attorneys handle a wide range of accident and injury cases.

Auto & Car Accidents

At-fault state, trained adjusters, lowball offers. We build the evidence that proves your full losses.

Helping victims of collisions caused by distracted, impaired, or reckless drivers recover full compensation for their injuries and losses. Idaho is an at-fault state, so the driver who caused the crash and their insurer are responsible for your damages, but adjusters are trained to dispute fault, question the severity of your injuries, and push lowball settlements. We investigate the scene, obtain police reports and traffic footage, work with medical experts to document your injuries and future care, and calculate the full value of your economic and noneconomic losses so nothing is left on the table.

Riders face bias from insurers and catastrophic injuries. We confront both with facts and evidence.

Protecting the rights of injured motorcyclists who too often face bias from insurers and are left to navigate complex claims on their own. Riders face dangers other drivers never encounter, and the injuries are frequently catastrophic, including traumatic brain injuries, spinal cord damage, and multiple fractures. According to the Idaho Transportation Department, 47 motorcyclists were killed on Idaho roads in 2024, and motorcycles accounted for roughly 20 percent of all serious injury crashes statewide. We confront insurer bias head-on with facts and evidence, address arguments about helmet use, and fight to hold negligent drivers fully accountable.

Slip & Fall Accidents

Owners must warn of hazards. We document conditions and identify every liable party, fast.

Holding property owners accountable when dangerous conditions cause serious injuries to customers, tenants, guests, and visitors. Under Idaho premises liability law, property owners must exercise reasonable care and warn of known hazards, yet insurers routinely argue the victim simply was not watching where they were going. These claims are often undervalued, so we document the dangerous condition, obtain incident reports and maintenance records, identify every liable party, and build the evidence needed to show the owner’s negligence caused the fall. When a fall happens on government property, a formal notice of claim must be filed within 180 days, which makes acting quickly essential.

Idaho Personal Injury Attorneys Fighting for You

When an accident turns your life upside down, you need more than sympathy. You need experienced legal representation. At Whalley Law, we help injured Idahoans and their families pursue full and fair compensation after accidents caused by someone else’s negligence. Whether you were hurt in a car crash on I-90, injured in a fall at a Boise area business, or seriously hurt in a motorcycle accident on Idaho’s highways, our team is ready to stand in your corner from day one.

Idaho’s roads are among the most dangerous in the country. According to the Idaho Transportation Department, traffic crashes in 2024 cost the state more than $5.5 billion, roughly $2,845 for every person in Idaho. Behind those numbers are real people dealing with broken bones, traumatic brain injuries, lost income, and lives turned upside down. Insurance companies know how to minimize claims and protect their bottom line, we know how to fight back.

At Whalley Law, we handle personal injury cases on a contingency fee basis, meaning you pay nothing unless we recover compensation for you. Our attorneys thoroughly investigate every case, work with medical experts and accident reconstructionists when needed, and negotiate aggressively with insurance carriers. When insurers refuse to make things right, we take the fight to court.

How Idaho Personal Injury Law Works

Most personal injury cases in Idaho are based on the legal principle of negligence. To recover compensation, an injured person must show that another party owed them a duty of care, breached that duty, and directly caused their injuries and damages. Insurance companies routinely challenge each element, which is why experienced legal representation matters.

Idaho follows a modified comparative negligence rule. Under Idaho Code § 6-801, you can still recover damages even if you share some responsibility for the accident, as long as your percentage of fault is less than 50 percent. However, your final compensation will be reduced by your share of fault. For example, if you are awarded $100,000 but found 20 percent at fault, you would receive $80,000. If your fault reaches 50 percent or more, you may be barred from recovering anything at all. These fault determinations are often fiercely contested, and having skilled legal counsel can make the difference between a full recovery and no recovery at all.

Idaho also limits, or caps, non-economic damages in personal injury cases. These are damages for things like pain and suffering, emotional distress, and loss of enjoyment of life. As of July 1, 2025, Idaho’s adjusted noneconomic damage cap was $509,013. Economic damages, such as medical bills, lost wages, and out-of-pocket losses, are not capped and can be recovered in full. Our attorneys work to document and maximize every category of damages available in your case.

Do Not Delay After an Injury

Time is one of the most critical factors in any personal injury case. In Idaho, the two-year statute of limitations begins on the date of your accident, not the date your symptoms worsen, not the date your medical treatment concludes. And for claims involving government entities, that window shrinks to just 180 days for filing a notice of claim.

Delaying also costs you evidence. Surveillance footage is overwritten. Witnesses’ memories fade. Physical conditions at accident sites change. Insurance companies begin building their defense the moment an accident is reported, and every day you wait gives them a head start.

At Whalley Law, we encourage anyone that has been injured in an accident to speak with our team as soon as possible. A prompt consultation lets us evaluate your case, identify any urgent deadlines, and take the steps necessary to preserve the evidence that will help prove your claim.

Don't wait. Evidence disappears.

Footage gets overwritten. Witnesses forget. Insurers start building their defense the day the accident is reported. A free consultation today protects your claim.
