How Idaho Personal Injury Law Works

Most personal injury cases in Idaho are based on the legal principle of negligence. To recover compensation, an injured person must show that another party owed them a duty of care,breached that duty, and directly caused their injuries and damages. Insurance companies routinely challenge each element, which is why experienced legal representation matters.

Idaho follows a modified comparative negligence rule. Under Idaho Code § 6-801, you can still recover damages even if you share some responsibility for the accident, as long as your percentage of fault is less than 50 percent. However, your final compensation will be reduced by your share of fault. For example, if you are awarded $100,000 but found 20 percent at fault, you would receive $80,000. If your fault reaches 50 percent or more, you may be barred from recovering anything at all. These fault determinations are often fiercely contested, and having skilled legal counsel can make the difference between a full recovery and no recovery at all.

Idaho also limits, or caps, noneconomic damages in personal injury cases. These are damages for things like pain and suffering, emotional distress, and loss of enjoyment of life. As of July 1, 2025,Idaho’s adjusted noneconomic damage cap was $509,013. Economic damages, such as medical bills, lost wages, and out-of-pocket losses, are not capped and can be recovered in full.
